Abstract

The New South Wales Law Reform Commission is conducting a review of the Bail Act 1978 (NSW). The Youth Justice Coalition considers this review from a ‘first principles perspective’ to be an important opportunity for NSW to develop bail principles and criteria consistent with existing child-specific legislation, notably the Children (Criminal Proceedings) Act 1987 (NSW) and the Young Offenders Act 1997 (NSW), as well as consistent with Australia’s international obligations concerning young people under the United Nations Convention on the Rights of the Child and the United Nations Standard Minimum Rules for the Administration of Juvenile Justice. |
