Queensland Handbook for Practitioners on Legal Capacity


The Handbook provides a guide for Qld lawyers on practical steps they might take if confronted with the possibility that their client may lack capacity to provide them with legal instructions.

It outlines the ethical duties owed by lawyers to their clients and to the court, and basic principles of law regarding capacity.

It is hoped that, armed with a better understanding of capacity, lawyers will be more willing to act for elderly clients and clients with disability, thereby increasing access to justice for these vulnerable groups of people.
